1. Scope
These terms apply to every order placed on berardiandco.ch and to all watch sourcing mandates. They prevail over any purchasing terms of the client unless otherwise agreed in writing. Berardi & Co may amend them; the version applicable is the one in force when the order is placed.
2. Products and availability
Watches are offered in a limited series. Photographs and descriptions are as accurate as possible, but slight variations in tone or finish, inherent to hand assembly, do not constitute a defect. An order is only firm once confirmed by Berardi & Co; where unavailability is established after payment, the order is cancelled and refunded in full within ten business days.
3. Prices
Prices are shown in Swiss francs (CHF). Shipping costs are displayed separately at checkout. Unless expressly stated otherwise at the payment step, prices are exclusive of Swiss VAT. For any delivery outside Switzerland, customs duties, import taxes and clearance fees are borne by the client and are not included in the displayed price.
4. Payment
Payment is made online through Stripe Payments Europe, which processes all card data. Berardi & Co has no access to any card data. Accepted methods are credit and debit card, TWINT, Apple Pay and Google Pay. Orders are processed only once payment has actually been received.
5. Delivery
Dispatch takes place within two business days of payment being received, insured and requiring a signature. Delivery times are indicative and do not constitute a firm commitment. The client must check the condition of the parcel on receipt and report any damage to the carrier and to Berardi & Co within forty-eight hours.
6. Transfer of risk and retention of title
Risk passes to the client when the parcel is handed to the carrier. The goods remain the property of Berardi & Co until the price has been paid in full, in accordance with articles 715 et seq. of the Swiss Civil Code.
7. Right of return
Swiss law provides no statutory right of withdrawal for online sales. Berardi & Co nonetheless grants a commercial right of return of fourteen days from receipt, for any unworn watch, complete, in its original packaging and with all accessories and documents. Return shipping costs are borne by the client, who bears the transport risk. This right does not apply to pieces acquired under a sourcing mandate, which are individualised by nature. For clients resident in the European Union, the fourteen-day right of withdrawal under Directive 2011/83/EU applies and takes precedence over this clause.
8. Warranty
Watches carry a contractual warranty of twenty-four months from the invoice date, covering defects in material and manufacture of the movement and case. Excluded are: normal wear, straps, the crystal, damage resulting from impact, immersion beyond the stated water resistance, intervention by an unauthorised third party, or improper use. The client has the period set out in article 210 of the Swiss Code of Obligations to report defects; apparent defects must be reported immediately on receipt.
9. Sourcing services
The sourcing mandate is governed by articles 394 et seq. of the Swiss Code of Obligations. Berardi & Co undertakes an obligation of means, not of result: no fee is due if no piece matching the brief is found. The commission is agreed in writing before the search begins and cannot be amended unilaterally. Berardi & Co takes no kickback from the seller. Authenticity checks are carried out with professional diligence, without Berardi & Co substituting for an independent expert appraisal which the client remains free to commission at their own cost.
10. Liability
The liability of Berardi & Co is limited to the amount of the order concerned, except in cases of wilful misconduct or gross negligence. It cannot be engaged for indirect damage, loss of use or loss of profit. No liability is assumed in cases of force majeure, delay attributable to the carrier, or customs hold.
11. Personal data
Data collected when an order is placed is processed in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the GDPR. Processing details are set out in the privacy policy linked in the footer.
12. Applicable law and jurisdiction
These terms are governed by Swiss law, to the exclusion of the Vienna Convention on Contracts for the International Sale of Goods. Exclusive jurisdiction lies at the registered office of Berardi & Co in Switzerland, subject to any mandatory consumer jurisdiction provided by law.
